ECL, passports, deportation and citizenship

Removal of names from the Exit Control List, impounded passports, deportation and blacklisting, citizenship and NADRA documentation, and visa-refusal representations, before the Ministry of Interior, FIA and the Lahore High Court.

Overview

Immigration matters in Pakistan are mostly about documents and the state's power over movement: a name placed on the Exit Control List because of a pending inquiry, a passport impounded at the airport, a foreign national's visa overstayed and a deportation order issued, a citizenship or CNIC application stuck at NADRA. Each has a legal remedy and a deadline, and each is easier to resolve before travel is booked.

Fortis Legal Partners makes representations to the Ministry of Interior for removal from the ECL and challenges unlawful listings before the Lahore High Court; acts in passport impounding and blacklisting matters with the Directorate General of Immigration and Passports and the FIA; and advises on citizenship, renunciation, POC and NICOP issues for Pakistanis and their families. We do not act for clients outside Pakistan, but we regularly represent families in Pakistan whose relatives are abroad.

What the process looks like

  1. 1

    Find out why

We obtain the basis of the ECL or blacklist entry, which department requested it, and whether the rules were followed.

  2. 2

    Representation

A representation to the Ministry of Interior with the documents that answer the reason for listing.

  3. 3

    Writ petition

If the representation is refused or ignored, a petition before the Lahore High Court, often with permission to travel for a fixed period.

  4. 4

    Compliance

Follow-through with the FIA and immigration authorities so the order is actually implemented at the airport.

Where these matters are heard

Lahore High Court

Governing law: Article 199 of the Constitution of Pakistan, 1973

Constitutional (writ) petitions under Article 199, civil and criminal appeals and revisions, bail before the High Court, and references from tax and customs tribunals. Both founding partners have been Advocates of the High Court since 2023.

NCCIA (formerly FIA Cyber Crime Wing) & PECA Courts

Governing law: Prevention of Electronic Crimes Act, 2016

Filing and defending complaints under PECA before the National Cyber Crime Investigation Agency (NCCIA), which took over the FIA Cyber Crime Wing's role in 2025: online harassment, defamation, identity theft, financial fraud and unauthorised access, and the trials and bail applications that follow.

Questions clients ask

There is no public list. Most people learn at the airport or through a notice. An advocate can make an inquiry with the Ministry of Interior and, if a listing exists, obtain its basis so that a representation can be filed.

A representation must be decided within the period set by the rules, but in practice the High Court route is often faster where travel is urgent. Courts regularly allow travel for a fixed period on undertakings while the listing is examined.

Ask this on WhatsApp

Yes, citizenship by descent is available under the Pakistan Citizenship Act on registration of the birth with the Pakistani mission and NADRA. The documents required and the effect of the other parent's nationality vary, so it is worth confirming before applying.
