Mutation, partition and the record of rights

Mutation (intiqal), partition, correction of the record of rights, demarcation and land disputes before the Revenue Courts, from the Tehsildar to the Board of Revenue, and the writs that follow in the Lahore High Court.

Overview

In Punjab, ownership of land lives in the revenue record: the jamabandi, the fard, the mutation register kept by the Patwari and attested by the Tehsildar. When that record is wrong, whether by error, by fraud or by an inheritance mutation that left out an heir, the remedy begins in the revenue hierarchy rather than in the civil court. Fortis Legal Partners was founded in Dera Ghazi Khan, where revenue work is the daily practice of the bar, and revenue matters remain one of the firm's core areas in Lahore.

We appear before the Tehsildar, Assistant Commissioner, Collector, Commissioner and the Board of Revenue on mutations and their appeals, partition of joint holdings, correction of entries, demarcation, and ejectment of unauthorised occupants. Where the revenue authorities have acted without jurisdiction, we take the matter to the Lahore High Court in its constitutional jurisdiction.

Who this is for

  • Heirs left out of an inheritance mutation, or facing a fraudulent one
  • Co-owners who want their share partitioned and separately recorded
  • Buyers whose mutation has been refused or delayed
  • Landowners in boundary, encroachment and tenancy disputes

Typical matters

  • Sale, gift and inheritance mutations (intiqal) and appeals against their attestation or rejection
  • Partition of joint khata under the Punjab Land Revenue Act
  • Correction of jamabandi and fard entries
  • Demarcation (nishandehi) and boundary disputes
  • Ejectment of tenants and trespassers from agricultural land
  • Pre-emption suits under the Punjab Pre-emption Act, 1991
  • Land acquisition awards and compensation references
  • Writ petitions against revenue orders before the Lahore High Court

Statutes and rules

  • Punjab Land Revenue Act, 1967
  • Punjab Tenancy Act, 1887
  • Punjab Pre-emption Act, 1991
  • Land Acquisition Act, 1894
  • Punjab Land Records Authority rules and the Registration Act, 1908

What the process looks like

  1. 1

    Pull the record

We obtain the current fard, the mutation history and the registered deeds, and trace where the entry went wrong.

  2. 2

    The right forum

Some errors are corrected by the Tehsildar in weeks; others need an appeal to the Collector or a civil suit. Choosing wrongly costs a year.

  3. 3

    Hearing and attestation

Representation before the revenue officer, with the Patwari's report and the parties' statements on record.

  4. 4

    Appeal, revision and writ

Appeals run to the Collector, Commissioner and Board of Revenue; jurisdictional errors go to the High Court.

Where these matters are heard

Revenue Courts & Board of Revenue

Governing law: Punjab Land Revenue Act, 1967 and Punjab Tenancy Act, 1887

The revenue hierarchy from the Tehsildar and Assistant Commissioner to the Collector, Commissioner and the Board of Revenue: mutation (intiqal), partition, correction of the record of rights, demarcation and ejectment.

District Courts, Lahore

The civil and sessions courts where most matters begin: civil suits before Civil Judges and Additional District Judges, and criminal trials before Magistrates and Sessions Judges. The firm was founded in the District Courts of Dera Ghazi Khan and still treats trial-court work as the core of the practice.

Lahore High Court

Governing law: Article 199 of the Constitution of Pakistan, 1973

Constitutional (writ) petitions under Article 199, civil and criminal appeals and revisions, bail before the High Court, and references from tax and customs tribunals. Both founding partners have been Advocates of the High Court since 2023.

Questions clients ask

Mutation is the entry in the revenue record that reflects a change of ownership after a sale, gift or death. It is not itself title, but without it your name does not appear in the fard, you cannot sell or mortgage easily, and a later fraudulent entry becomes harder to undo.

An appeal lies to the Collector against the mutation, and a civil suit for declaration can be filed to set aside the entry and the shares recorded under it. Act promptly: courts protect heirs' shares, but long delay can weaken a claim, especially where the excluded heir dies without having asserted it.

Computerised fards are issued at Arazi Record Centres and through the Punjab Land Records Authority's online service on payment of a fee. For pending or disputed entries, the manual record with the Patwari may still need to be inspected.
