You have bought a plot, inherited agricultural land or received property by gift, and someone has told you to get the intiqal done. This guide is for owners, buyers and heirs in Punjab who want to understand what a mutation is, why it matters even after a registered deed, how the Arazi Record Centre process works, and what to do when an entry is refused or wrongly made.
What mutation (intiqal) is and why it matters
A mutation is the entry made in the revenue record when ownership or another right in land changes hands. Section 42 of the Punjab Land Revenue Act 1967 requires every person who acquires a right in land, whether by purchase, inheritance, gift, mortgage or otherwise, to report the acquisition so that the record of rights can be updated. The register in which owners are listed is still called the jamabandi or register haqdaran-e-zamin, and the extract you receive from it is the fard-e-malkiat.
A mutation does not itself create title. Title comes from the transaction: the registered deed, the death of the previous owner, the decree of a court. But the mutation is what the world reads. Banks, buyers, the sub-registrar and the tax authorities all look at the fard, and an owner whose name is not in it will struggle to sell, mortgage or defend the land.
Since the Punjab Land Records Authority Act 2017, the record has been computerised and the work of the patwari in this respect has moved to the Arazi Record Centre in each tehsil. There, a Service Centre Official enters the mutation and an Assistant Director Land Records, acting as revenue officer, attests it after verifying the parties.
The fard is what the world reads. The deed is what the court reads. Both have to be right.
Types of mutation in Punjab
Sale mutation (intiqal bai) follows a registered sale deed. Registration and mutation are now linked, so that a deed registered through the e-registration system generates the mutation entry, which the buyer then completes at the centre. Gift mutation (intiqal hiba) records a gift; in practice the centre requires a registered gift deed and the donor's own appearance. Inheritance mutation (intiqal wirasat) is entered on the death of an owner in favour of all legal heirs according to their shares, on the basis of the death certificate and NADRA's family record, without any court decree if no one disputes the heirs. Exchange, mortgage and redemption of mortgage have their own entries, partition of joint holdings proceeds under section 135, and a mutation on the basis of a court decree gives effect to a judgment. Clerical errors in an existing entry are corrected through fard badar.
The revenue hierarchy: who does what
| Level | Officer | Role in mutation |
|---|---|---|
| Arazi Record Centre (tehsil) | Service Centre Official; Assistant Director Land Records as revenue officer | Entry, verification and attestation of the mutation; issue of fard |
| Field | Patwari and Girdawar (Kanungo) | Field report, possession and crop record where the centre calls for it |
| Tehsil | Naib Tehsildar and Tehsildar (Assistant Collector) | Partition proceedings, demarcation, disputed entries referred to them |
| District | Collector (Deputy Commissioner) and Additional Collector | First appeal against the attesting officer's order |
| Division | Commissioner | Second appeal and revision |
| Province | Board of Revenue | Final appeal, revision and review |
Sections 161 to 164 of the Act govern appeals, their time limits, review and revision. An appeal to the Collector lies within 30 days of the order, to the Commissioner within 60 days and to the Board of Revenue within 90 days, and the higher officers may also call for the record in revision on their own motion.
Property mutation procedure step by step
Complete the underlying transaction
For a purchase, register the sale deed before the sub-registrar or at the e-registration counter, with stamp duty and the applicable taxes paid. For inheritance, obtain the death certificate and the family registration certificate from NADRA. For a gift, have the gift deed registered.
Apply at the Arazi Record Centre of the tehsil where the land lies
Take a token, present the CNICs, and have the parties biometrically verified. In a sale both seller and buyer appear; in an inheritance all heirs appear or are represented under a registered power of attorney.
Verification of the record
The official checks the existing entry, the chain of previous mutations and any encumbrance or pending litigation noted in the remarks column. For inheritance, the heirs are matched against the NADRA family record and the legal-heir certificate from the Union Council.
Attestation by the revenue officer
The Assistant Director Land Records records the statements of the parties and attests the mutation. Where another person has an interest, notice issues and objections are heard before attestation.
Collect the attested copy and the updated fard
Obtain the copy of the attested mutation (naqal intiqal) and a fresh fard-e-malkiat. Read both against the deed: khasra numbers, area, shares and the spelling of names.
If refused or wrongly entered, appeal in time
An order refusing or wrongly attesting a mutation is appealable to the Collector within 30 days. Clerical mistakes in an otherwise correct entry are corrected through fard badar rather than appeal.
Documents you will need
- CNICs of every party, and of the attorney if a power of attorney is used
- For a sale: the registered sale deed and registration receipt, the latest fard, the previous mutation and the stamp duty and tax receipts
- For inheritance: the death certificate, the NADRA family registration certificate, the legal-heir certificate from the Union Council, and the fard of the deceased's holdings
- For a gift: the registered gift deed and the donor's personal appearance
- For a court decree: certified copies of the judgment and decree
- Any no-objection certificate required by a housing scheme or cooperative society
- A registered power of attorney, attested by the Pakistani mission, for a party living abroad
Timelines and costs
A sale mutation linked to a registered deed is usually entered and attested within days to a few weeks of the parties' appearance. An inheritance mutation commonly takes several weeks, longer where an heir lives abroad or the family record needs correction. Partition proceedings under section 135 run for months and often longer. An appeal before the Collector is typically decided within a few months.
Government charges such as mutation fee, stamp duty and the taxes collected at registration are fixed by schedule and paid at the counter. Professional fees depend on the forum and the stage and are confirmed in writing.
Common mistakes in mutation cases
- Relying on the deed alone and never completing the mutation, only to find the record still in the seller's name years later.
- Buying without a fresh fard, and inheriting a mortgage or a pending case with the land.
- Entering an inheritance mutation in the name of one brother for convenience, which the other heirs then have to undo.
- Leaving daughters or the widow out of an inheritance mutation. The entry is unlawful and can be reopened, and Punjab law now provides a fast route for women to recover their shares.
- Ignoring a notice of attestation, so that the entry is made without you.
- Missing the 30-day appeal period.
- Handing the file to an agent. The signatures and biometrics must be yours, and the receipt should stay with you.
When to speak to an advocate
Speak to an advocate before a purchase where the chain of title has gaps, where the land is joint or under mortgage, or where the seller is acting under a power of attorney. Speak to one immediately if an inheritance mutation has been entered without you, if the centre refuses an entry, or if a notice of appeal or revision arrives. Read more about our revenue and land practice and our civil litigation work on title disputes, or book a consultation and bring the fard with you.
FAQ
You need both. The registered deed is your title document; the mutation records the change in the revenue record so that the fard shows you as owner. Without it you cannot easily sell, mortgage or defend the land, and a later buyer or heir may find the record still in the old name.
Ask this on WhatsAppA sale mutation linked to a registered deed is usually entered and attested within days to a few weeks. An inheritance mutation takes longer, typically several weeks, because the death record and the heirs are verified. A disputed mutation can take months.
Ask this on WhatsAppYes. An appeal lies to the Collector within 30 days, then to the Commissioner and the Board of Revenue, and review and revision are also available. A mutation does not itself create title, so a civil suit remains open where the underlying transaction is disputed.
